Toronto Tempo Ticket Deposit Policy
Tempo Basketball Club Inc. Toronto Tempo Season Ticket Deposit List Terms and Conditions (the “Terms”)
By participating in a List (defined below), List members fully and unconditionally accept these Terms and the decisions of Tempo Basketball Club Inc. (“Tempo”), all of which are final and binding on all matters relating to the List(s).
DEPOSIT PROCESS
HOW TO JOIN: To add your name to (or confirm your place on) the List(s), please complete the following steps:
- Go to https://am.ticketmaster.com/tempo/membershipdeposit
- select a “Deposit” for a maximum of four (4) season tickets per account for Tempo games played at Coca-Cola Coliseum and Scotiabank Arena in Toronto, Ontario (each, a “Season Ticket”); and
- submit and pay the required payment in full for your deposit in accordance with the payment instructions (the “Deposit”). Deposits are non-refundable, unless otherwise required by applicable law.
LISTS: The Deposit is consideration to secure a spot on one of two waiting lists: (i) the list for premium Tempo Season Tickets (the “Premium List”); and (ii) the list for standard Tempo Season Tickets (the “Standard List”, and together with the Premium List, the “List(s)”, and each a “List”).
An individual/company/entity may only register one (1) account and make one (1) Deposit per List for up to four (4) Season Tickets. For clarity, only one (1) spot on each List may be occupied by a given individual/company/entity. If it is determined by Tempo, in its sole discretion, that a List member, whether new or current, occupies more than one (1) spot on a List, the highest priority ranking position (as determined by Tempo) will be maintained and all other spots on such List for such List member may be deleted without notice.
Current and new List members are responsible for ensuring their: (i) contact information remains accurate and up to date; and (ii) Deposit balance is paid in full.
List members can update the contact information for their List member account at any time by signing into Account Manager. In the event of a deficiency in the Deposit amount held on account of a List member, List members can arrange for any required payments by contacting Ticketmaster. In the event a deficiency in the Deposit amount held on account of a List member has not been rectified prior to a deadline specified by Tempo in its sole discretion, Tempo reserves the right to terminate a List member’s participation in the applicable List, and any remaining Deposit balance will be moved to an account credit which can be used towards the future purchase of other Tempo ticket products.
List members may only purchase Season Tickets for their own personal and/or hospitality use, unless otherwise agreed by Tempo. Tempo may terminate participation in the List(s) and refund the amount paid for the Deposit in the event it is determined by Tempo, in its sole discretion, that the prospective customer intends to use tickets acquired for commercial resale purposes.
By participating in a List, you agree to be bound by these Terms and the decisions of Tempo, which are final with respect to all matters relating to the List(s). Tempo accepts no responsibility for List applications (or enrollment forms) which are lost, misdirected or delayed for any reason, nor is any responsibility assumed for incorrect or inaccurate capture of enrollment form information, including (but not limited to) technical malfunction, human error, lost/delayed/garbled applications, Internet/e-mail transmission, omissions, interruptions, deletions, defects, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof. Except where excluded by applicable law, Tempo disclaims all conditions, warranties, whether express, implied, statutory or otherwise related to these Terms and the List(s).
COST
The cost of a standard Deposit (“Standard Deposit”) is $100.00 CAD per ticket, up to a maximum of four (4) tickets (or a maximum of $400.00 CAD). Members who pay Standard Deposits shall be placed on the Standard List.
The cost of a premium Deposit (“Premium Deposit”) is $250.00 CAD per ticket, up to a maximum of four (4) tickets (or a maximum of $1,000.00 CAD). Members who pay Premium Deposits shall be placed on the Premium List.
A List member may reserve a place on both the Premium List and the Standard List by paying both the Premium Deposit and the Standard Deposit.
As consideration for being an early member, and notwithstanding anything else herein, any List member that paid a Deposit of $100.00 CAD prior to April 1, 2025 is on the Standard List; however, such original members may also join the Premium List, without losing their place on the Standard List, by paying an additional $150.00 CAD.
If a List member decides not to purchase Season Tickets, if and when such tickets become available, the Deposit money is non-refundable but can be moved to an account credit, which can be used towards the future purchase of other Tempo ticket products.
AVAILABILITY OF SEASON TICKET LOCATIONS
List members understand and agree with the following:
- Being a member of a List does not guarantee any right to receive the opportunity to purchase a Season Ticket within a specified period of time, if ever;
- The offer to purchase a Season Ticket is at the sole discretion of Tempo, including the number and locations of tickets made available for purchase by List members and the timing of such offers;
- Some tickets are retained for Tempo business holds, upgrades and other internal service or business purposes of Tempo, and these will be given priority over the List; and
- While List members will be contacted in priority sequence based on their respective position on the applicable List, the opportunity to select ticket locations will be limited to the ticket inventory presented by Tempo at the time of List member’s selection.
SEASON TICKET OFFERS
Each WNBA season, after available ticket inventory has been identified by Tempo, Tempo will contact eligible members on the List(s) for which ticket inventory is available, in order of priority on the applicable List. When a List member is selected, they will be contacted by a representative of Tempo. Contact will be made by way of telephone or email from the contact information provided on the selected List member’s enrollment form or updated by such member (i.e., on their account).
List members will be provided with five (5) business days (inclusive of the date of first contact) (or such other period of time as Tempo may allow, in its sole discretion) from the first attempted contact by Tempo (whether by phone or email) to respond to Tempo regarding their intention to purchase Season Tickets (the “Purchase Window”). If the List member fails to respond within the Purchase Window, they will forfeit their opportunity to purchase Season Tickets. Tempo reserves the right to contact another List member regarding the opportunity to purchase Season Tickets at any time, including during the Purchase Window, and the List member could forfeit the opportunity to purchase Season Tickets if another party purchases the Season Tickets in question. Tempo is not responsible, whether as a result of human error or otherwise, for any failure to contact a List member regarding an offer to purchase Season Tickets.
If a List member elects to purchase Season Tickets, they will be required to provide Tempo with their complete account information within the Purchase Window, and will be required to make any additional deposits/payments for the Season Tickets through a Tempo-designated payment method. If the List member fails to provide the required information within the Purchase Window, they will forfeit their opportunity to purchase the selected Season Tickets. Tempo is not responsible, whether as a result of human error or otherwise, for any failure to contact a List member regarding an offer to purchase Season Tickets.
All Season Tickets purchased will be subject to Tempo’s ticket department policies then in effect (as the same may be amended from time to time) including, without limitation, any applicable personal ticket license requirements, transfer restrictions and transfer fees.
A List member has the right to decline (or not respond to) the first two (2) offers to purchase Season Tickets, while still maintaining their priority on the applicable List. If a third offer to purchase Season Tickets is declined (or not responded to) by a List member, that List member will be reassigned a priority at the bottom of the applicable List.
MISCELLANEOUS
- In the event of a conflict between these Terms and any instructions or interpretations of these Terms given by an employee of Tempo regarding the List(s), these Terms shall prevail.
- If it is discovered by Tempo (using any evidence or other information made available to, or otherwise discovered by Tempo) that any List member has used or attempted to use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to register for a List more than once, that person may be removed from such List and their Deposit may be forfeited, in the sole discretion of Tempo.
- A List member may be requested to provide Tempo with reasonable proof that they are the Authorized Account Holder of the email address associated with their List member account. In the event of a dispute regarding the identity of a List member, the List member will be deemed to be the Authorized Account Holder in whose name the email account is registered. “Authorized Account Holder” shall mean the natural person assigned to an email address and/or telephone number by an Internet access provider, online service provider, telephone service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
- By participating in a List, List members agree to hold harmless and indemnify Tempo and their affiliates, the Women’s National Basketball Association and its member teams, and each of their officers, directors, governors, partners, principals, employees, representatives, agents, affiliates and related entities, (altogether, the “Released Parties”) against any and all liability, damages or causes of action (however named or described) with respect to or arising out of either: (i) the List member’s participation in the List(s); and (ii) the administration of the List(s) by Tempo.
- (Not applicable to Quebec residents or where excluded by applicable law) List members hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which a List member or any of its representatives, heirs, next of kin or assignees (“Member’s Representatives”) may have or which may hereinafter accrue to the List member or Member’s Representatives against the Released Parties as a result of the List member’s participation in the List(s).
- The following is prohibited and will result in automatic disqualification from the List(s) and forfeit of any Deposit: (1) violation of or non-compliance with these Terms; and (2) any other act which Tempo determines, in its sole discretion, to jeopardize the security, fairness, integrity or proper administration of the List(s). Any attempt to deliberately damage any website or to undermine the legitimate operation of the List(s) is a violation of criminal and civil laws and, should an attempt be made, Tempo reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
- Season Ticket purchases made using (i) an NSF (non-sufficient funds) cheque; (ii) unauthorized credit card; or (iii) lost, stolen or fraudulent credit cards will result in immediate disqualification from the List(s) and forfeit of any Deposit.
- Season Tickets and membership in the List(s) are personal privileges and are non-transferable and these Terms are not assignable by List members, unless otherwise permitted by Tempo. By participating in the List(s), each List member confirms that the List member is the real party of interest and that the List member is not acting for or on behalf of any undisclosed principals, person or third party and that Tempo shall be entitled to deal solely and exclusively with the List member as to all matters relating to the List(s), without further investigation or inquiry on its part.
- Tempo may terminate, modify, suspend or withdraw the List program (and/or any aspect thereof), in whole or in part, at any time, and for any reason, without notice or liability, in its sole discretion. Tempo may periodically amend any portion of these Terms. Any such amendment will be effective at least thirty (30) days following either Tempo’s dispatch of a notice to you or Tempo’s posting of the amendment. If you do not agree to any change to these Terms, you must remove yourself from the applicable List. Any Deposit money in your account will be moved to an account credit, which can be used towards the future purchase of other Tempo ticket products.
- Tempo respects your right to privacy. Personal information collected from List members will only be used by Tempo to administer the List(s) and, only if consent is actively given at the time of registration for a List, to provide List members with information regarding upcoming offers, promotions and/or events of Tempo or its affiliates. For more information regarding the manner of collection, use and disclosure of personal information by Tempo, please refer to Tempo’s privacy policy, available at http://www.wnba.com/toronto/privacy-policy.
- (Not applicable to Quebec residents) These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Without limiting the generality of the foregoing, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations as between any person and Tempo in connection with the List(s) shall be governed by and construed and interpreted in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. List members hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter, issue or dispute arising under or in respect of these Terms or the List(s) and agree that any such determination shall be brought solely and exclusively before such courts.
- The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. If Tempo does not act to enforce a breach of these Terms, that does not mean that Tempo has waived its right to enforce these Terms.
- The parties have agreed that this contract and all related documents be drafted in English. Les parties aux présentes ont demandé et convenu que le présent contrat et tout document y afférent soient rédigés en anglais.

Tempo Basketball Club Inc. Fan Club (the “Fan Club”) Terms and Conditions (the “Terms”)
Participation in the Fan Club for twelve (12) months by paying a Payment (as defined below) and/or becoming a member of the Fan Club (a “Member”), constitutes full and unconditional agreement with and acceptance of these Terms and the decisions of Tempo Basketball Club Inc. (“Tempo”), all of which are final and binding on all matters relating to the Fan Club. This Fan Club membership will auto-renew annually unless the Member opts-out in advance of the Renewal Date.
PAYMENT PROCESS
HOW TO JOIN: To confirm your Fan Club membership, please complete the following steps:
- go to https://am.ticketmaster.com/tempo/membershipdeposit
- select “Tempo Fan Club Membership” (maximum of one (1) Fan Club membership):
- submit and pay the required payment in full in accordance with the payment instructions (the “Payment”). Payments are non-refundable unless otherwise required by applicable law.
COST: The cost of a Payment for a twelve (12) month membership in the Fan Club in 2025 is $50.00 CAD per person. The cost for future years will be determined by Tempo (in its sole discretion) and communicated to the Member prior to any renewal as described below.
DEPOSITS: Any individual who has paid a deposit (a “Deposit”) for a Fan Club membership in 2024 or 2025 may activate their membership in the Fan Club for a twelve (12) month term by converting their Deposit to a Fan Club membership at no extra cost by responding to Tempo’s offer to activate a Fan Club membership. If an individual who placed a Deposit: (i) selects not to activate their Fan Club membership in response to Tempo’s offer; or (ii) fails to respond to the Tempo offer to activate their Fan Club membership within sixty (60) days, the Deposit can be moved to an account credit, which can be used towards the future purchase of other Tempo ticket products.
AUTO – RENEWAL: Each Fan Club membership will automatically renew on the annual anniversary of the date of the Member’s initial Fan Club membership activation (the “Renewal Date”). Upon renewal, Members will be automatically charged a Fan Club membership renewal fee as may be determined by Tempo in its sole discretion (the “Renewal Fee”). The Renewal Fee will be automatically processed using the payment information on file unless the Member opts out of renewal before the applicable Renewal Date. Tempo will provide Members with at least thirty (30) days’ advance written notice of the Renewal Fee amount and the upcoming Renewal Date.
PAYMENT AUTHORIZATION: The Member understands that by making a Payment, the Member gives Tempo authorization to charge the Member for the Renewal Fee on the Renewal Date. This payment authorization shall remain in effect for so long as the Member’s account remains in good standing with Tempo or until Member rescinds this payment authorization in accordance with these Terms. The Member hereby represents and warrants to Tempo that it has the authority to approve charges in accordance with the listed payment information for the purpose of paying for the Fan Club membership. The Member understands and agrees that Tempo is not liable in any way for erroneous billing statements or incorrect charges, and that in the event of such a billing error, Tempo’s only responsibility is to correct it if and when Tempo receives written notice of the error.
CANCELLATION: Members may cancel their Fan Club membership by signing into “My Account” and following the applicable prompts, however Members will not receive any refunds or credits for any Payments made prior to the cancellation becoming effective. Members will have access to all Fan Club membership benefits until the effective cancellation date (the next Renewal Date), at which time all Fan Club membership benefits will end.
An individual/company/entity may only make one (1) Payment.
For clarity, only one (1) Fan Club membership may be occupied by a given individual/company/entity.
Members are responsible for ensuring their: (i) contact information remains accurate and up to date; and (ii) Payment balance is paid in full.
